The political divide in the United States may be as large as it has ever been, and it keeps getting wider. Countless clips on social media back this up, and they almost always go viral, because viewers love to watch people argue about pretty much anything. Take this recent TikTok, for example. The clip has around 502K likes and 4.7 million views, and it shows a man getting into a heated altercation with an older couple in North Carolina, including a man in a MAGA hat.
North Carolina Man in MAGA Hat Tells TikToker to ‘Go Back Up North,’
Unfortunately, the TikTok starts with the altercation already underway. Even so, the man recording managed to capture most of the encounter. Viewers see an older gentleman in a bright red MAGA hat look into the camera and say, “Go back up north. We don’t need you, people around here.” He also calls the man a “hippie.” But the older man may be in for a rude awakening, because the man recording says he was actually born in Georgia, not up north.
As the video continues, the older man gets backup from his wife. She complains about the man recording their interaction, saying, “Because he’s so smart, and so clever.” She also asks the man behind the camera if this is his career. He responds with another surprise, saying he is a veteran of the United States Marine Corps.
TikTok Reacts To Older North Carolina Couple’s Confrontation
The comment section had plenty to say about the altercation. One user wrote, “That vet card is going to shut them up every time.” Another asked, “Why are they angry 24/7?” “I think she was flirting with you, bro,” joked one more. Finally, one last commenter wrote, “The fact that both of them are wearing blue is really taking me out.”
The clip ends with the couple saying they won’t stoop to the level of the man with the camera. That doesn’t last long, though, because the woman then says she could beat him up. The older man says they can step into the parking lot, but nothing comes of it. The video ends with the couple leaving and the man behind the camera saying, “That was good.” In the end, nothing came of the altercation, but it does show how wide the political divide in the U.S. has grown.
Is It Legal To Record People In Public In North Carolina?
The man in the TikTok was recording an argument that was aimed directly at him, so many viewers may wonder whether he was allowed to film it. According to WCNC Charlotte’s reporting, you can film in public areas, and a legal expert said you can video virtually anybody or anything while in public. The First Amendment protects filming in public spaces where there is no expectation of privacy, such as sidewalks and parks, per wcncaol
Audio is covered too. North Carolina is a one-party consent state, so recording audio is legal as long as one participant in the conversation knows about it. Since the man was part of the confrontation, that rule applies to him, reports the Carolina Journal.
There are limits. Filming people in private spaces like bedrooms and bathrooms is a misdemeanor in North Carolina, and stores and restaurants are private property, so owners can ban filming on their premises. If the altercation happened on private property, such as a business parking lot, the owner’s rules could come into play.
Can You Be Arrested For Peaceful Protesting?
Interactions like this one are sadly common these days, and most of the time, one person or the other threatens to involve law enforcement. People have, in fact, been arrested while protesting, despite their First Amendment rights. For the most part, though, it isn’t the protesting itself that gets them in trouble.
According to ACLU, peaceful protests can lead in arrests if protesters block traffic or sidewalks, trespass on private property, or disobey lawful orders. They can also be arrested of they use disruptive tactics such as blocking access doors, chaining themselves to buildings, or failing to cooperate once detained.
One California TikToker even recorded a video where he claims the local police were disrupting a peaceful protest in September of 2025.
This encounter may not be a aggressive as others found on social media. However, it does show how divided the political climate has become.
Noticed News reached out to the TikToker via direct message and will update with any new information.
